Chapter 1 General Provisions
Article 1 The general provisions set forth herein are for the management of European Studies: Comparative Law and European Law postgraduate training, and will effectively improve the quality of postgraduate training, according to the Sapienza University of Rome University Manifestio and the Regulations on the Management of Project Students in Regular Higher Education Institutions promulgated by the Ministry of Education of the People's Republic of China (Ministry of Education Order No. 41), and the Administrative Measures for the Cultivation of Postgraduates of Zhongnan University of Economics and Law (Revised) (Zhongnan Dayanzi [2018] No. 14) and other documents, specially formulated these measures.
Article 2 Students under this project are jointly trained by Sapienza University of Rome, and Zhongnan University of Economics and Law. The project complies with the curriculum system and training standards put forth in the Master's degree in European Studies: Comparative Law and European Law managed by Sapienza University of Rome and focuses on the management, inspection and supervision of training links, and the evaluation of training quality.
Chapter Two Training Goals and Training Methods
Article 3 Training goals
1. Overall goal: Establish and improve the training mechanism for innovative legal talents, cultivate international first-class legal talents, train for modernization, the comprehensive development of morality and intelligence, foster an innovative spirit and global vision, and facilitate outstanding legal expertise. This program seeks to create professionals who are capable of engaging in foreign-related legal practice and researching international frontier legal theoretical issues.
2. specific target:
Abide by the national constitution of the PRC and it’s laws, to encourage patriotism, noble ideals, good morals as well as physical and mental health. This program seeks to facilitate the ability for students to understand and implement the country's foreign policy and foreign policy.
Program students should be proficient in English, and able to engage in foreign-related work and legal practice in state agencies, enterprises and institutions, well-known law firms at home and abroad, multinational corporations and other institutions. They should have a comprehensive understanding of international rules and develop the ability to work competently in international and multinational organizations. They must also gain proficiency in Italian, with basic Italian reading, writing and communication skills.
The program seeks to cultivate the ability to engage in legal teaching and scientific research in universities and research institutes at home and abroad and to build a platform for further studies in domestic and foreign universities and research institutes, and lay a good foundation for project students to continue their studies. The program also encourages students to engage in physical exercise and maintain and healthy body and mind.
Article 4 Training methods
1. Implement the basic principles of integrating theory with practice, unifying requirements and teaching students in accordance with their aptitude, and require project students to master the theoretical foundation of their major and the ability to solve practical problems.
2. Implement the mode of combining the mentor guidance and the collective training of the mentor group, and Italian and Chinese teachers will teach and train together to ensure that the project students can not only receive the education and influence of foreign experts, but also obtain the guidance and cultivation of domestic experts.
3. Adopt the combination of systematic knowledge learning and specific scientific research, the combination of classroom interactive teaching and off-class group discussion, the combination of teacher instruction and independent exploration of project students, and the combination of theoretical study and case study to fully mobilize project students. The enthusiasm for learning and scientific research, to cultivate the ability of independent academic analysis of problems and innovative problem solving.
4. The implementation of flexible and diverse training methods such as the combination of on-campus learning and off-campus practice requires project students to actively participate in the work of international and transnational organizations, well-known law firms and well-known enterprises at home and abroad while solidly mastering the professional knowledge. Accumulate practical experience in foreign-related legal practice.
5. Actively carry out the ideological and political work of project students, cultivate their moral character and legal professional ethics and promote their comprehensive development.
Chapter III Basic Educational System and Length of Study
Article 5 The basic academic system of European Studies: Comparative Law and European Law for master's degree students is 2 years, with a conditional and flexible study period, and the study period is 2 to 6 years. Within the aforementioned time limit, project students who fail to complete the learning tasks specified in the training plan, complete the required credits, or pass the graduation thesis review, cannot obtain a master's degree certificate. For those who cannot complete their studies normally due to health reasons, the length of study period may be appropriately extended.
Article 6 European Studies: Comparative Law and European Law master's degree students who fail to obtain a master's degree certificate within 2 years may apply for an extension of the study period in accordance with Article 5. Those who need to extend the length of study should submit the European Studies: Comparative Law and European Law Postgraduate Extension Application Form (applicants who apply for extension of the length of study due to the failure of the thesis defense should go through the application procedures after the defense). After review by the college, it is reported to Sapienza University of Rome for approval.
Article 7 After the expiration of the study period of the project students, the completion of the learning tasks specified in the training plan, the completion of the required credits, and the graduation (degree) thesis are approved by the supervisor, the graduation qualification review can be conducted. Only after passing the graduation qualification review can the thesis double-blind review and thesis defense in accordance with the regulations.
Those who pass the review of the above links will be issued a master's degree certificate by Sapienza University of Rome after the review.
Project students who have not completed the learning tasks specified in the training plan within the specified learning period, or have not completed the specified credits, or have not completed the graduation thesis, shall be treated as undergraduates. For graduate students who have not met the graduation requirements but are unwilling to extend the length of study, they are directly treated as undergraduates.
Chapter IV Training Program and Training Plan
Article 8 The formulation and revision of the European Studies: Comparative Law and European Law training program aims to improve graduate students' innovative ability and cultivate graduate students' global vision, strengthen the organic combination of legal theory and legal practice, and strengthen innovation ability and global vision cultivating and exploring the formation of a unique Sino-foreign cooperative training model. Attention should be paid to systematic theoretical training for postgraduates, requiring and supporting postgraduates to participate in high-level, cutting-edge, and international legal research, and supporting high-level postgraduate training with high-level legal research. The program encourages interdisciplinary training and the broadening academic horizons. The program facilitates the participation of international and foreign-related legal practices and accumulate legal practice experience.
Article 9 The curriculum system of European Studies: Comparative Law and European Law includes public courses and professional courses. The professional courses are formulated by Sapienza University of Rome and are taught in English; Italian teachers are the main courses instructors with assistance from Chinese teachers. Public courses are taught by Chinese teachers arranged by Zhongnan University of Economics and Law.
Article 10 The European Studies: Comparative Law and European Law project implements a training model that combines mentor guidance and collective training of mentor groups.
Chapter 5 Credits and Course Study
Article 11 The curriculum of this project is divided into public courses and professional courses. There are four public basic courses, including English, Italian, Socialist Theory and Practice with Chinese Characteristics, and Marxism and Social Science Methodology. There are 14 professional courses, including Comparative Private Law, European Public Law and Comparative Law, International Law, History of European Law, Roman Law Foundation in European Law, European Law Foundation, European Union Law, European Litigation and Arbitration, European Administrative Law and Comparative Law, European Tax Law, Law and Economics I, Law and Economics II, European Commercial Law, European Private Law and Comparative Law.
Article 12 The total credits of the course of this project are 75 credits, 66 of which are from degree courses.
Article 13 While completing the prescribed courses, project students should also carry out extracurricular study, academic training and practice in accordance with their personal training plan. Extracurricular learning, academic training and practical practice is jointly overseen by both Italian and Chinese teachers.
Article 14 Project students must participate in and complete the arranged courses in accordance with the requirements of the major as outlined by Sapienza University of Rome.
Chapter VI Classroom Learning Discipline and Course Assessment
Article 15 Project students should arrive at the place of class on time, and according to the rules of get out of class time, they are not allowed to be late, leave early or be absent from class. Except for special reasons, those who are unable to attend classes due to illness or due to circumstances should ask for leave from the Academic Affairs Secretary of the Chinese-Italian Institute in advance and obtain approval, and they are not allowed to make up leave afterwards. Anyone who has not asked for leave or who is not approved for leave, or who has been approved but fails to go through the formalities for renewal of leave after the expiry of the time limit and who fails to attend the course shall be regarded as absenteeism.
Article 16 Project students should make preparations before class, bring books, materials, notebooks and necessary learning tools related to class, and abide by normal classroom rules.
Article 17 Project students who have one of the following circumstances will automatically disqualify for course assessment, and the course scores will be counted as zero points:
1. Class absenteeism rate exceeds 1/3;
2. Missed more than 1/3 of the usual homework.
Article 18 All courses set up in the training program of this project need to be assessed. The assessment is divided into two types: examination and examination. Course evaluation follows normal examination methods, and practical teaching and special discussions follow the regular examination methods out forth in the course, including closed-book written examination, open-book written examination, oral examination, combination of written examination and oral examination, writing essay (design), writing research reports and other methods. The test time and location are designated by the Chinese-Italian Institute.
Article 19 Examination and Disciplinary Requirements
Candidates should enter the exam room 10 minutes before the exam and be seated in the designated position. Those who are more than 30 minutes late will not be allowed to enter the venue and will be treated as absent from the exam. Students must remain in the exam room for at least 30 minutes after the start of the test; only then will exam papers be allowed to be handed in. Candidates should earnestly and honestly complete the answer sheet independently within the specified time. Anyone who violates the discipline of the examination room or cheats will be given corresponding disciplinary sanctions in accordance with relevant regulations.
The Chinese-Italian Institute is responsible for verifying the materials related to the violation of discipline and cheating in the examination, and determining the nature of the violation and cheating and the preliminary sanction results. The final punishment result is decided by Sapienza University of Rome and Zhongnan University of Economics and Law. If a project student disagrees with the sanction decision, within 5 working days from the date of receiving the sanction decision, they may file a written appeal to the Chinese-Italian Institute.
Article 20 Performance Management
The overall evaluation scores of the project students' examination courses are composed of regular exam scores and assessment scores.
The professional course follows a 30-point system, and the minimum evaluation score is 18 points to obtain credits for the course. The public course adopts a 100-point system, and the minimum evaluation score is 60 points in order to obtain credits for the course.
Students who are disqualified from the assessment, miss the exam, or cheat during the exam will receive a zero grade for the course.
Article 21 Query and Review of Results
Project students should check their grades online. Students can log in to the project student account of Zhongnan University of Economics and Law for public class scores, and log in to the project student account of Sapienza University of Rome for professional class scores. If there are any questions regarding the test results, students are able to raise their concerns to the Chinese-Italian Institute in writing during the first week of the following semester.
Article 22 Re-examination and Re-study
Candidates cannot apply for re-examination and re-study if the overall evaluation score of professional courses reaches 18 points. A score of less than 18 for professional courses will be considered as unqualified, and you can apply for a re-examination. If the retest does not reach 18 points, the course must be retaken. The postgraduate students who require re-examination must submit the European Studies: Comparative Law and European Law project postgraduate re-examination application form. After the approval of Sapienza University of Rome, the application form should be submitted to the Chinese-Italian Institute for the record. For postgraduates who need to retake a full course, submit the European Studies: Comparative Law and European Law project postgraduate restudy application form, and submit it to the Chinese-Italian Institute for the record with the approval of Sapienza University of Rome.
Candidates cannot apply for re-examination and retake if the overall evaluation score of public courses reaches 60 points. The general evaluation score of public courses is less than 60 points as unqualified, and unqualified courses must be retaken. The postgraduates who need to retake the master's degree should submit the Application Form for Retake of Zhongnan University of Economics and Law, and after approval, it should be reported to the Chinese-Italian Institute for the record.
Article 23 Postponement
Postgraduates who are unable to participate in the course assessment within the prescribed time due to unforeseen circumstances and meet one of the following conditions may be allowed to postpone the exam:
1. Those who cannot participate in the assessment due to medical reasons (diagnostic certificate issued by the school and hospital is required);
2. A major family event that requires the student’s attention at home;
3. Other circumstances as determined by the Chinese-Italian Institute where the student is unable to participate in the course assessment.
If students are unable to take the professional course examination for some reason, should fill in the European Studies: Comparative Law and European Law Project Postgraduate Examination Application Form, with the consent of the teacher and the Chinese-Italian Institute. If students are unable to take the public course exam for some reason, completion of the Application Form for Postgraduate Examination of Zhongnan University of Economics and Law is required and must formally be submitted to the Chinese-Italian Institute for record.
The postponement test is generally arranged in the first week of the following semester, and the postponement test results are recorded according to normal assessment procedures. The postponement of professional courses is arranged by the Chinese-Italian Institute, and the postponement of public courses is arranged by the Chinese-Italian Institute For postgraduates who have not undergone formal exam postponement arrangements of the e the Chinese-Italian Institute will not accommodate them further, and such students must directly retake the course.
Chapter 7 Graduation (Degree) Thesis
Article 24 Project students must write graduation (degree) thesis in English or Italian. The topic of the thesis must be related to the major, and the word count and format of the thesis must meet the graduation (degree) thesis requirements of Sapienza University of Rome.
Article 25 One Chinese instructor and one Italian instructor will be assigned to students for graduation (degree) thesis. The thesis shall be reviewed in accordance with the relevant regulations of Sapienza University of Rome.
Chapter 8 Supplementary Provisions
Article 26 These Measures are applicable to postgraduates of the educational program of European Studies: Comparative Law and European Law.
Article 27 The Measures shall be implemented from the date of promulgation.
Article 28 This method is interpreted by Sapienza University of Rome and the European Studies: European Law and Comparative Law project management committee.
